Woman Files Lawsuit Alleging Femur Fracture After Five Years of Fosamax Use

A South Carolina woman has filed a lawsuit against Merck & Co. after suffering a femur fracture allegedly caused by use of the company’s osteoporosis drug Fosamax, which she took for a period of five years.

The lawsuit joins many others in the mass tort litigation filed against Merck and other drug manufacturers in the Superior Court of New Jersey, Atlantic County Law Division.

Plaintiff Took Fosamax From 2005 to 2010

According to the lawsuit, the plaintiff began taking Fosamax in December 2005, and suffered a fracture in her right femur in 2010. She says that bisphosphonates like Fosamax were designed to treat  bone loss consistent with osteoporosis and osteopenia. She claims, however, that the drug can actually increase the risk of fracture by causing bones to become more brittle. Moreover, the lawsuit says that Merck knew or should have known about this risk, yet failed to warn consumers and their doctors, while continuing to market the drug as a treatment for bone loss, a condition that is prevalent among postmenopausal women.

The lawsuit alleges “severe physical and mental pain and suffering, emotional distress, permanent injuries, and economic loss due to medical expenses and living expenses due to the requirements of a new lifestyle.”  The plaintiff is seeking, among other things. compensatory, punitive, and statutory damages.

A recent FDA analysis and a study published in the Journal of the American Medical Association in May 2012, revealed data consistent with the plaintiff’s injury, noting that roughly 82 percent of study participants who suffered femur fractures were taking a bisphosphonate drug such as Fosamax. The study authors added that “drugs like Fosamax increase atypical femur fracture risk, [and] that longer bisphosphonate treatment further raises the risk.”
