Woman Files Fosamax Suit Against Merck in Illinois

An Illinois woman has filed a Fosamax lawsuit against Merck Sharp & Dohme Corporation (Merck), alleged that the company made exaggerated claims about the benefits of its top-selling osteoporosis medication.

Lawsuit Filed in St. Clair County

On January 24 Susan Lange of Washington County, Illinois, filed suit against Merck on behalf of Vera Lange in St. Clair County Circuit Court. The complaint claims that Vera Lange was prescribed Fosamax, a member of a class of drugs known as bisphosphonates, under the impression that it prevents bone loss and reduces the risk of fractures. According to Lange, however, Fosamax in fact weakens bones and raises the likelihood of a bone injury. She alleges that Merck was aware of long-term Fosamax side effects but nonetheless kept the drug on the market.

Lange’s charges against Merck include negligence, fraud, and breach of warranty. She is seeking $300,000 in damages in addition to court fees.

Merck Faces Thousands of Fosamax Lawsuits

Lange’s case adds to the legal woes of Merck, which now faces thousands of Fosamax lawsuits in state and local courts. While the majority of these suits charge that Fosamax causes osteonecrosis of the jaw (ONJ), a debilitating condition that can result in jaw bone death, a growing number relate to the alleged tendency of Fosamax to cause atypical femur fractures. Fosamax femur fractures, which can occur with little or no trauma, are typically associated with long term use (5 or more years) of the drug. As a result, some doctors recommend a temporary lapse in treatment (a so-called “drug holiday“).
