An Indiana woman has suffered not one, but two femur fractures allegedly caused by prolonged use of Fosamax. She has filed a lawsuit against the drug’s manufacturer, Merck & Co., Inc.
The lawsuit, filed in Superior Court of New Jersey, Atlantic County Law Division, states that the woman took Fosamax for a number of years prior to fracturing her left femur in July 2010 and her right femur in October of the same year. The complaint alleges that her use of the drug caused both breaks. The woman claims that Merck failed to warn consumers about the increased risks of femur fractures when using Fosamax, even though it knew about these risks. Further, the woman states that had she been aware of these risks, she would not have used the medication.
In addition to suffering two fractured femurs, the lawsuit says the defective drug caused the woman severe mental and physical pain and suffering, permanent injuries, emotional distress, economic loss due to medical expenses, and related expenses due to a modified lifestyle.
Bisphosphonates are Supposed to Reduce the Risk of Fractures
Fosamax and other bisphosphonates are supposed to reduce the risk of bone fractures in patients with osteoporosis and other conditions that might cause bone loss, but this lawsuit claims the drug may do just the opposite. The suit alleges that a component of the drug “suppresses bone turnover while allowing secondary mineralization, and when used long-term, can cause the bones to become brittle and vulnerable to fracture.”

Despite its side effects, Fosamax could help those who are at high risk of suffering bone loss.
